Terms of Service

Kodo: Heart Rate Monitor

Effective date: June 12, 2026

These Terms of Service ("Terms") form a binding agreement between you ("you," "your," or "user") and Azimjon Abdurasulov ("we," "us," "our," or the "Developer") governing your access to and use of the Kodo: Heart Rate Monitor mobile application and all related features and services (collectively, the "App"). Please read these Terms carefully before using the App.

1. Acceptance of Terms

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not download, install, access, or use the App.

Your use of the App is also subject to Apple's Licensed Application End User License Agreement ("Apple Standard EULA") and the Apple Media Services Terms and Conditions. To the extent these Terms conflict with the Apple Standard EULA with respect to your use of the App obtained from the App Store, the Apple Standard EULA will govern that conflict, except where these Terms are more restrictive, in which case the more restrictive terms apply.

2. Important Wellness Disclaimer — Kodo Is NOT a Medical Device

Please read this section carefully. It is one of the most important parts of these Terms.

For wellness and informational purposes only. Kodo is NOT a medical device and does NOT measure blood glucose. Heart rate is estimated from your camera; glucose values are only those you synced from Apple Health — never measured by this app. Not intended to diagnose, treat, cure, or prevent any condition. Always consult a healthcare professional.

You expressly acknowledge and agree that:

• The App is intended solely for general wellness, fitness, and informational purposes. It is not a medical device, is not intended for medical use, and has not been evaluated, cleared, or approved by any regulatory authority.
• Heart rate is estimated from your device's camera using photoplethysmography (PPG) and may be inaccurate. Stress scores derived from heart-rate variability are estimates and should not be treated as clinical measurements.
• The App does not and cannot measure blood glucose. Any glucose values displayed are only those that you have synced into Apple Health from other apps or devices. The App is read-only with respect to glucose and never measures or records glucose itself.
• The App's outputs are not a substitute for professional medical advice, diagnosis, or treatment. Never disregard, avoid, or delay seeking professional medical advice because of anything you read or see in the App.
• You should always consult a qualified healthcare professional with any questions about your health, before starting any health, fitness, or breathing program, and before making any decision related to a medical condition.
• If you think you may have a medical emergency, call your doctor or emergency services immediately. Do not rely on the App in any situation where inaccurate or incomplete information could lead to injury, death, or property or environmental damage.

You use the App and rely on its outputs entirely at your own risk.

3. License to Use the App

Subject to your continuous compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and install one copy of the App on an Apple-branded iPhone that you own or control, and to use the App for your own personal, non-commercial purposes, all in accordance with the Apple Standard EULA and the usage rules set out in the Apple Media Services Terms and Conditions.

This license does not grant you any ownership interest in the App. All rights not expressly granted to you are reserved by us and our licensors.

4. Eligibility and Age

The App is rated 4+ and is suitable for general audiences. However, to enter into these Terms and to make purchases, you must be at least the age of majority in your jurisdiction (or have the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf and is responsible for your use of the App). By using the App, you represent and warrant that you meet these requirements and that all information you provide is accurate.

The App is designed for personal use by adults and by minors under appropriate parental or guardian supervision. It is not intended for use in making any health decision for a minor without the involvement of a qualified healthcare professional.

5. Subscriptions and Billing (Kodo Plus)

5.1 Free Tier

You may use core features of the App at no cost. The free tier includes unlimited heart-rate measurement, stress score, guided breathing, 7-day history, Apple Health sync, and the glucose overlay.

5.2 Kodo Plus

"Kodo Plus" is an optional premium offering that unlocks additional features, including 90-day history, a combined heart-rate + glucose timeline, trend analysis, custom reminders, an ad-free experience (the App is ad-free regardless), and data export (planned for version 1.1 and subject to availability). Features may be added, changed, or removed over time.

Kodo Plus is available through the following options:

5.3 Auto-Renewal Terms

For auto-renewing subscriptions (Yearly and Monthly):

• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews at the then-current price for the same period unless you turn off auto-renewal at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage your subscription and turn off auto-renewal at any time by going to your App Store account settings after purchase.

5.4 Free Trial

The Yearly plan includes a 7-day free trial introductory offer where eligible. If you do not cancel at least 24 hours before the trial ends, your subscription will automatically convert to a paid Yearly subscription and your Apple ID will be charged $39.99. Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable. Free-trial eligibility is determined by Apple and may be limited to one per subscription group.

5.5 Lifetime Purchase

The Lifetime option is a one-time, non-consumable purchase that does not auto-renew and is not a subscription. It unlocks the Kodo Plus features available at the time, for the lifetime of the App on your Apple ID, subject to these Terms and Apple's usage rules.

5.6 Payment, Refunds, and Restore

All purchases are processed by Apple through the App Store and StoreKit. We do not receive, see, or store your payment-card data. Billing, renewals, cancellations, and refunds are handled by Apple in accordance with the Apple Media Services Terms and Conditions and applicable App Store policies. To request a refund, contact Apple Support; we are generally unable to issue refunds directly for purchases made through the App Store.

You may restore eligible purchases (such as the Lifetime purchase) by using the restore function within the App, subject to Apple's verification of your Apple ID.

5.7 Price Changes

Prices are stated in U.S. dollars; the amount charged in your local currency may vary based on your App Store region and applicable taxes. We may change subscription prices and feature sets. Where required, Apple will notify you of price increases and, where applicable, ask for your consent to continue your subscription before the change takes effect.

6. Acceptable Use

You agree that you will not, and will not permit anyone else to:

• Use the App for any unlawful, harmful, fraudulent, or unauthorized purpose, or in violation of these Terms or any applicable law or regulation.
• Use the App as a medical device or for any diagnostic, clinical, or emergency purpose.
• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the limited extent such restriction is prohibited by applicable law.
• Rent, lease, lend, sell, sublicense, distribute, or otherwise transfer or make the App available to any third party.
• Remove, alter, or obscure any proprietary notices (including copyright or trademark notices) in the App.
• Circumvent, disable, or interfere with security-related features of the App or features that restrict use or copying of content, or that enforce limitations on use.
• Use any automated means, bots, or scrapers to access the App, or interfere with or disrupt the integrity or performance of the App.
• Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.

7. Intellectual Property

The App, including its software, design, text, graphics, illustrations, logos, the "Kodo" name and branding, user interface, and all related content (excluding your own data), and all intellectual property rights therein, are owned by the Developer and its licensors and are protected by copyright, trademark, and other laws. These Terms do not transfer any ownership rights to you.

The data you generate through the App (such as your heart-rate and stress measurements) belongs to you and is stored locally on your device, as described in our Privacy Policy. We do not claim ownership of your personal health data.

"Apple," "iPhone," "App Store," "Apple Health," "HealthKit," and "StoreKit" are trademarks of Apple Inc. Their use here is for descriptive purposes only and does not imply any endorsement.

8. Your Data and Privacy

All measurements are stored locally on your device. The App has no account, no sign-up, and no server or cloud component. We do not use tracking, third-party analytics, or advertising SDKs. Your health data is never sent to any third party and never leaves your device except into your own Apple Health, and only with your permission. Camera frames are processed in real time only to estimate heart rate; no image, photo, or video is stored or transmitted. For full details, see our Privacy Policy.

Because data is stored only on your device, you are responsible for maintaining your own backups. Deleting the App, resetting your device, or losing your device may result in permanent loss of your data, and we cannot recover it for you.

9. Third-Party Services

The App integrates with Apple Health (HealthKit) at your option and with your permission, and relies on the App Store for distribution and payments. Your use of these services is governed by Apple's applicable terms and policies. We are not responsible for the practices, availability, or content of any third-party service.

10. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. We and our licensors expressly disclaim all warranties and conditions, whether express, implied, or statutory, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

We do not warrant that the App will meet your requirements; that it will be uninterrupted, timely, secure, or error-free; that any measurements, heart-rate estimates, stress scores, or other outputs will be accurate, reliable, or complete; or that defects will be corrected. Any health-related information provided by the App is for general wellness purposes only and is not guaranteed to be accurate. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE DEVELOPER OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, OR FOR ANY PERSONAL INJURY OR HEALTH-RELATED HARM, arising out of or relating to your use of, or inability to use, the App or any reliance on its outputs, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total aggregate liability for all claims relating to the App will not exceed the greater of (a) the total amount you paid to us, if any, for the App or Kodo Plus during the twelve (12) months preceding the event giving rise to the claim, or (b) USD 10.00.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

12. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Developer and its licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your misuse of the App, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

13. Termination

These Terms remain in effect until terminated. Your license and these Terms will terminate automatically, without notice, if you fail to comply with any provision of these Terms. You may terminate at any time by ceasing all use of the App and deleting it from your device.

Upon termination, all rights granted to you under these Terms will end, and you must stop using and delete the App. Termination does not entitle you to any refund except as required by applicable law or Apple's policies. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14. Changes to the App and to These Terms

We may modify, suspend, or discontinue the App or any of its features at any time, with or without notice, to the extent permitted by law. We may also update these Terms from time to time. When we make material changes, we will revise the "Effective date" above and, where appropriate, provide additional notice within the App. Your continued use of the App after the updated Terms take effect constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the App.

15. Apple-Specific Terms

You and we acknowledge that these Terms are concluded between you and the Developer only, and not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support services for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product-liability claims, any claim that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Developer is established, without regard to its conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence provide you with additional rights that cannot be waived. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any disputes will be subject to the exclusive jurisdiction of the competent courts of the Developer's jurisdiction, subject to any mandatory rights you have under your local law. The usage rules and dispute provisions of the Apple Media Services Terms and Conditions also continue to apply to purchases made through the App Store.

17. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy and the Apple Standard EULA, constitute the entire agreement between you and us regarding the App and supersede any prior agreements on the subject.
• Severability. If any provision of these Terms is held to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
• Headings. Section headings are for convenience only and have no legal effect.
