These Terms of Use ("Terms") govern your use of the MoodFlix iOS app ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

Plain English. No legalese where we can avoid it.

1. Who you are agreeing with

The App is built and operated by Azimjon Abdurasulov as an indie developer ("we", "us", "our"). There is no company; the App is a personal project published through the Apple Developer Program.

2. License — what you can do

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, in line with Apple's Media Services Terms and Conditions and the Apple App Store Standard End User License Agreement (Standard EULA) referenced at:

The Standard EULA applies to your use of the App, except where these Terms explicitly extend or differ from it. In any direct conflict, the Standard EULA controls for App Store distribution matters; these Terms control for product-specific behavior described below.

3. What you may not do

You agree not to:

  • Reverse-engineer, decompile, disassemble, or attempt to derive source code from the App, except as expressly permitted by applicable law.
  • Modify, adapt, translate, or create derivative works of the App.
  • Remove, obscure, or alter any copyright, trademark, or proprietary notices.
  • Use the App to violate any law, regulation, or third-party right.
  • Use the App to harass, defame, or harm other users of TMDB or any third-party service the App integrates with.
  • Attempt to bypass, disable, or interfere with security or rate-limit features of the App, TMDB, or Apple services.
  • Use the App to scrape, mass-download, or republish TMDB content in a way that violates the TMDB API Terms of Use.
  • Use the App in any safety-critical context (medical, aviation, nuclear, life-support). The App is for entertainment discovery only.

4. TMDB attribution and third-party content

The App uses The Movie Database (TMDB) API but is not endorsed, certified, or otherwise approved by TMDB. All movie, TV, and person metadata, images, and ratings displayed in the App are provided by TMDB and are subject to TMDB's own Terms of Use and Privacy Policy:

When you sign in with your TMDB account through the App, you are contracting directly with TMDB for that account. We do not see your TMDB password and we are not party to your TMDB account agreement.

Streaming-service availability ("watch on Netflix / Apple TV+ / Disney+", etc.) is sourced from TMDB / JustWatch and may be inaccurate, region-locked, or out of date. We do not control or guarantee that data.

5. Your TMDB token and account

The App requires a TMDB v4 Read Access Token to load public movie and TV data. The App ships a default read-only token with api_read scope so you can browse without registering. You may also paste your own token in Settings → Replace API token to use your own quota.

Account-level features (your TMDB Watchlist, ratings, custom lists) require you to sign in with your own TMDB account through the in-app OAuth flow. You are solely responsible for:

  • The security of your TMDB account credentials.
  • Compliance with TMDB's terms.
  • Any content you create on TMDB through the App.

6. Privacy

Your privacy matters. The App does not run analytics, does not track you across apps, and stores all your data on your device. See the full Privacy Policy at AppStore/PrivacyPolicy.md (also linked from the App Store listing and the in-app About screen).

7. Halal-safe content posture

The App is built with a Muslim audience in mind. By default:

  • Every TMDB search and discover request sets includeAdult: false.
  • The default content rating cap is PG-13 (you can change this in Settings).
  • The "Family Time" mood applies an additional family-friendly post-filter.

We make a reasonable effort to filter out adult, gambling, and alcohol-glorifying content, but TMDB metadata is provided by volunteers and is not guaranteed to be perfect. If you find content that should be filtered and is not, email azimxxm@gmail.com and we will investigate.

You are responsible for your own viewing choices on third-party streaming services that the App links out to.

8. In-app purchases and pricing

The App is currently distributed free of charge on the App Store. There are no subscriptions, no in-app purchases, and no advertising at the time of this document's last-updated date.

If we ever introduce paid features, the price and terms will be shown clearly in-app before any charge is made, and Apple's standard purchase, refund, and family-sharing rules will apply through your Apple ID.

9. Notifications

If you enable provider-availability alerts ("notify me when this title is on Netflix"), the App uses iOS Local Notifications. There is no remote push infrastructure. You can revoke notification permission at any time in iOS Settings → MoodFlix → Notifications.

10. Updates and availability

We may release updates that fix bugs, add features, change behavior, or remove features. iOS may install updates automatically based on your device settings.

We may discontinue the App, remove it from the App Store, or stop maintaining it at any time, with or without notice. Because the App runs entirely on your device against the public TMDB API, an abandoned version may continue to work as long as TMDB's API contracts remain stable.

11. Disclaimers — read this carefully

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT:

  • The App will be uninterrupted, timely, secure, or error-free.
  • The information shown (titles, ratings, availability, runtimes, cast, release dates) is accurate, complete, or current.
  • Defects in the App will be corrected.
  • The App is compatible with every iPhone or iOS version.

You use the App at your own risk. Nothing in the App is professional advice of any kind.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF — OR INABILITY TO USE — THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 5.00.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability — in those jurisdictions, the limits above apply only to the extent permitted by law.

13. Indemnity

You agree to indemnify and hold harmless Azimjon Abdurasulov from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your use or misuse of the App.
  • Your violation of these Terms.
  • Your violation of TMDB's terms or any third-party right.

14. Apple-required provisions (App Store Standard EULA references)

Because the App is distributed through the Apple App Store, the following Apple-mandated provisions apply:

  1. The Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
  2. Scope of license. The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  3. Maintenance and support. We are solely responsible for any maintenance and support services with respect to the App. Apple has no obligation whatsoever to furnish maintenance or support services with respect to the App.
  4. Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  5. Product claims. You acknowledge that we, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including (i) product liability claims, (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
  6. Intellectual property rights. In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, we, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such infringement claim.
  7. Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Termination

These Terms remain in effect until terminated. We may terminate or suspend your license at any time, without notice, if we believe you have violated these Terms. You may terminate at any time by deleting the App from your device.

On termination: the license ends, and you must stop using the App. Sections 3, 4, 6, 11, 12, 13, 14, 16, and 17 survive termination.

16. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this document shows when. Material changes will be flagged in the App's release notes. Continuing to use the App after the update means you accept the new Terms. If you don't agree, stop using the App and uninstall it.

17. Governing law and disputes

These Terms are governed by the laws of the Republic of Uzbekistan, without regard to conflict-of-law principles. Subject to mandatory consumer-protection laws of your country of residence, any dispute will be resolved in the competent courts of Tashkent, Uzbekistan.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction whose laws grant you non-waivable rights, those rights are not affected by this section.

18. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision will be reformed to the minimum extent necessary to make it enforceable while preserving its intent.

19. Entire agreement

These Terms, together with the Privacy Policy and the Apple Standard EULA, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.
